The Supreme Court has granted the petition ofIlocos Norte Rep. Imee Marcos Manotoc to nullify the civil proceedings before
the Pasig City regional trial court in connection with the bid of the family of a murdered student to enforce a US court ruling ordering her to pay $4.4 million in compensation for his death. On grounds of invalid substituted service of summons, the SC's Third Division through Associate Justice Presbiterio Velasco Jr. gave way to Marcos petition to reverse the rulings of
the Court of Appeals and the Pasig RTC branch 163 that ruled in favor of the family of the late Archimedes Trajano. Trajano, 21, an engineering student at the Mapua Institute of Technology, was killed on Sept. 2, 1977 after heheckled Marcos. Trajano was allegedly abducted by Marcos’ bodyguards and beaten up before he died. On March 20, 1986, Trajano’s mother sued Marcos in the US
district court in Hawaii for “wrongful death through torture, false imprisonment, kidnapping and deprivation of rights of the deceased Archimedes Trajano, as well as emotional distress on the part of the mother, committed by military intelligence officials of the Philippines under the command, direction, authority, supervision, toleration, sufferance and/or influence of defendant (Marcos).
